Validity of the GTC and contract closing
These general terms and conditions (GTC)
are valid for purchase agreements with private clients and companies which have been concluded on www.serv24-it.ch (subsequently denoted as provider). The order gets confirmed by the provider.
The contract is concluded when the confirmation reaches the client. If the confirmation by the provider is absent within an appropriate period, the client may regard this as a refusal of the order and he has the right to conclude the contract with another provider. These GTC also apply to purchase agreements which are being concluded in another way, e.g. via phone call, fax or mail.
The clients are being adverted in the order confirmation where they can download the GTC on the internet. If a client doesn’t agree with the GTC, he may use his right of withdrawal (see pt. 4).
Prices and special offers
The prices are indicated in Swiss francs (CHF). Value added tax (VAT) and treatment are included in the price. Delivery charges will be cleared apart. The provider reserves the right to change the prices at any time. Prices displayed at the moment of the order are relevant for the client.
Payment and delivery
After an accomplished order, the payment is due within 10 days on our bank account.
In the event of non-payment, the following reminder fees are due:
1st reminder = CHF 30.00 CHF processing fee
3rd reminder = CHF 50.00 mobile blocking
Lockout fees are always 50 CHF per lock
The claim is being forwarded to the collection agency after the 3nd reminder. The default interest is 12%
Clients with payment defaults
The provider reserves the right to restrict the payment options of clients with payment defaults. Prepayment or payment by credit card are two possibilities.
Special requirements for SLA clients
As with every insurance, we can’t enter damage or orders before the beginning of our SLA subscriptions while the SLA is running. Therefore, orders or damage before the running time are being invoiced like normal bills.
Right of withdrawal and cancellation right
The client is allowed to cancel the contract within 7 days and without a declaration of reasons. There will be no fees charged for this, except if the client has purchased some services before. The cancellation period starts on the day when the goods purchased arrive at the client. Goods already purchased can be sent back at the expense of the client. Bills already paid will be refunded by the provider without any further fees. If a client resigns from the contract because of late delivery or flaws on the goods or for other reasons for which the provider is responsible, the provider will refund all amounts already paid and the costs of return. The limitation period amounts to one year after receipt of the service (see OR 210 par. 1).
Special requirements for calls on customers
All of the appointments arranged with Serv24-IT Gastl are mandatory. If the client cannot keep an appointment, he may inform us by mail at least 48 hours before the hour of appointment. Cancellations received after this deadline will be charged with a fee of at least CHF 200.00.
Liability and warranty
The client is required to approve that the delivered goods have no flaws as soon as possible. If there are any flaws, he may inform us immediately. When flaws are noticed, the client has got four options: free amendment, decline, refusal of contract or replacement. The right of the consumer to demand indemnification is reserved in every case.
Liability for online connections
The provider is not liable for flaws or interruptions he is not responsible for, especially not for security flaws or failures of third-party suppliers he works with or he is depending on. The provider is not liable for acts of nature, inappropriate proceeding or contempt of risks by clients or third parties, intervention of clients or interruption by third parties (e.g. viruses), even if precautionary measures have been made.
Application of law and legal domicile
Swiss law applies for these GTC, namely the code of obligations (Obligationenrecht, OR).
The legal domicile is CH – 8157 Dielsdorf a/A.
